Can they be sued if the comic steals the underlying idea but not the artwork itself? I don't think so... it's not as if the original artist copyrighted the idea!
Not that I approve of it, of course. I think their entries should not be chosen at all. What's the point of being able to produce pictures if you have to steal ideas for it?

There's a very good chance that the original cartoon was in fact copyrighted and may have been that artist's original idea. Using an image, an idea, etc. and making it your own I don't have a problem with at all...it's the idea that in this case it's almost verbatim and no mention/credit was made of the original work - that's plagerism and if the original artist saw this they could try to take legal action - either against the person who submitted it, Neo or both (the person for submitting, Neo for publishing).
In a very general, vague way whenever you put something on the internet it is "copyrighted" - I don't completely understand the law on this one. At the same time, we all know that it's super easy to do a search or stumble across something and take it or have it taken if we're the original artist.
Out and out art theft is wrong. Entering an "original" cartoon, drawing (think BC, Art gallery - so many flagrantly stolen images, down to the original artist's name), claiming it as your own original work when you know it isn't just makes me and alot of us angry.
Using another's image/quote, etc. I think is ok IF you make sure you give credit in some way and IF the person says it's ok to use. If they state that you absolutely cannot use their image, etc., then steer clear and respect that. That's what I do anyway.
