After some testing, I've come to a few conclusions.
Firstly: Yes, Sink, Burrow and Drain Life are using 39% energy instead of 40%. If you look at the progression of the numbers, 39 is logical. It started out as 50% for each, but TNT realized that after using two abilities, you had 0% energy, and thus, could not defend/berzerk/fierce etc. They decided to make the change to 49% to leave each player with 2%, enough to do all of the aforementioned. TNT, thinking this harsh (speculation on my part), lowered it to 39% to allow for another ability to be used. After testing these abilities for about an hour or so, I discovered that Burrow and Sink were not blocking as they should be (as you probably noticed if you were on Battledome Chat at the time).
Further testing led me to the theory (which has been tested and proven) that the energy used to back Burrow/Sink is proportional to the amount blocked. To explain, I'll use Burrow as an example. For every 40 energy used, as was the case prior to these changes, a 100% block of the damage inflicted by the icons Burrow defends (everything except light and dark). A Burrow on weak, using 10 points of energy, by this logic, would defend 25% of the damage inflicted by Burrow's icons. The formula you can derive from this, to determine the amount of damage blocked, is as follows:
Damage Blocked = (Amount of damage dealt to you) * ((Amount of energy used) / 40)
No one, including myself, noticed a change when the abilities cost 50%, or 49% for the simple fact that you were defending more than was being dealt to you, which resulted in 0 damage total. However, now that 39 is the magic number, you get a few damage trickling through, even though it appears as if all icons are being blocked.
